- What is the procedure for recovery of Colombian Citizenship?
According to Law 43 of 1993, regulated by Decree 1869 of 1994 and amended by Law 962 of 2005, Colombian nationals by birth or by adoption who have lost or renounced the Colombian nationality, may reassume it by means of a written statement filed with the Ministry of Foreign Affairs, Colombian Consulates or Governors’ Offices in Colombia and fulfillment of the relevant requirements and documents stipulated by applicable laws in force. Accordingly, a “resumption certificate” shall be issued, stating that the Colombian nationality has been reassumed.
II Requirements and Documentation
For Colombian by birth:
- Written application filed with the Ministry of Foreign Affairs, Colombian Consulates, or Governors' Offices in Colombia, indicating the will of the petitioner to endorse and observe the Political Constitution and the laws of Colombia; if applicable, mention any other nationality held by the applicant. It should be noted that the term for filing this application is two (2) years from the date of issuance of the certificate renouncing Colombian citizenship.
- Citizenship card or birth certificate.
- Five (5) photographs, 4 x 5 centimeters, on blue background.
- The Internal Working Group of Nationality of the Ministry of Foreign Affairs or the corresponding Governor's Office or Consulate shall summon the applicant in order to notify him/her of the record of recovery of Colombian nationality.
It is recommended that a copy of the certificate renouncing Colombian nationality and the document showing the date of acquisition of another nationality be attached to the documents
For Colombians by naturalization:
- Written application filed with the Ministry of Foreign Affairs, Colombian Consulates, or Governors' Offices in Colombia, indicating the will of the petitioner to endorse and observe the Political Constitution and the laws of Colombia; if applicable, mention any other nationality held by the applicant. It should be noted that the term for filing this application is two (2) years from the date of issuance of the certificate renouncing Colombian citizenship.
- Citizenship card or another document proving that the applicant had obtained Colombian nationality.
- Certificate of good conduct and police record issued by the Administrative Department of Security (Departamento Administrativo de Seguridad - DAS)
- Proof of residency in Colombia for at least one (1) year prior to the submission of the application for resumption of citizenship.
- The Internal Working Group of Nationality of the Ministry of Foreign Affairs or the respective Consulate shall summon the applicant in order to notify him/her of the resolution regarding the relinquishment [sic] of the Colombian nationality.
It is recommended that a copy of the adoption of Colombian nationality, as well as of the certificate of relinquishment of Colombian nationality be attached to the documents.
